Raffle Rules

OFFICIAL RULES

Montezuma County Republican Central Committee (“MCRCC”) is conducting the Montezuma County Dream Home Raffle (the “Raffle”) to raise funds to educate potential voters on Republican principles, educate students at all grade levels on the political process, and provide for scholarships. The rules of the Raffle, set forth below, govern the Raffle, award of prizes, and participation in the Raffle. These Rules bind every person (a “Ticket Holder”) who buys or holds a Raffle ticket. By purchasing or holding a ticket, each Ticket Holder agrees (a) to be bound by these Rules and (b) that MCRCC’s interpretation and application of these Rules is conclusive and final.

Grand Prize: The Montezuma County Dream Home, 3BR / 2BA, 2-Car garage, Golf cart parking, on a
lot in Fairview Estates, near hole 2 of the Conquistador Golf Course.

 

Max Tickets Sold: 2000
 

Cancellation Clause: At least 1400 Raffle tickets must be sold for raffle of Grand Prize to proceed.
As set forth in the “Cancellation Clause” section below, the number of tickets sold determines if MCRCC will
award the Grand Prize. The Raffle will only proceed with awarding the Grand Prize to a Ticket Holder
once 1400 tickets or more have been sold. If 1400 have not been sold by the closing date of 12:00 PM on
December 30, 2019, then the raffle will be cancelled and refunds given (see Cancellation Clause listed below
for more information). Once this minimum threshold has been reached, we will inform the public on our website
and via Facebook that the raffle is proceeding.

 

All drawings are open to the public, but the winner need not be present to win.
 

Raffle Ticket Information
 

Raffle Ticket Cost: 1 ticket for $250.00
Only one Eligible Ticket Purchaser (as defined below in the “Eligibility” section of these Rules) may purchase a
ticket. This means, (a) one name per ticket and (b) one purchaser per ticket. An Eligible Ticket Purchaser may
designate another person a Ticket Holder. If a ticket names more than one person as a Ticket Holder and that
ticket is a winning ticket, then MCRCC will (a) deem the person named first on the ticket as the Ticket Holder,
(b) declare the first person named on the ticket as the winner, and (c) award the prize to the first person named
on the ticket. In such case, the division of the prize shall be the sole responsibility of the first person named on
the ticket. Once MCRCC awards the prize to the first person named on a ticket, MCRCC will have no further
duties or obligations with respect to the division of the prize and all persons named on a ticket as Ticket
Holders release MCRCC from all claims relating to the award of the prize or its division among other persons
on a ticket named as Ticket Holders. An Eligible Ticket Purchaser may purchase more than one ticket, with the
only limit being the number of total tickets available for purchase.


The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for
valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions.

 

Purchaser and Ticket Holder Eligibility : To be eligible to purchase a ticket, a ticket purchaser (an “Eligible
Ticket Purchaser”) must (a) be at least 18 years old at the time of purchase, (b) be a U.S. resident physically
residing in the United States or District of Columbia, and (c) not be precluded by Applicable Law (as that term
is defined in the “Registration with the State of Colorado and Applicable Law” section of these Rules”) from
holding or purchasing a ticket or participating in a raffle.


If a ticket is purchased by an Eligible Ticket Purchaser who designates another person as the Ticket Holder,
then that person must (a) be at least 18 years old at the time of purchase, (b) be a U.S. resident physically
residing in the United States or District of Columbia, and (c) not be precluded by Applicable Law (as that term
is defined in the “Registration with the State of Colorado and Applicable Law” section of these Rules”) from
holding or purchasing a ticket or participating in a raffle.

 

A person cannot be an Eligible Ticket Purchaser or a Ticket Holder if such person or holder is a person (a) with
whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign
Asset Control of the Department of the Treasury (including those named on OFAC’s Specially Designated and
Blocked Persons List”) or under any statute or executive order or (b) who is acting, directly or indirectly, for or
on behalf of any such person.

 

MCRCC reserves the right to require reasonable evidence of the eligibility of an Eligible Ticket Purchaser or
Ticket Holder at any time and to void any ticket sold to a person who does not meet the eligibility requirements
or who is precluded by applicable law from holding a ticket or participating in a raffle.

 

Online:

Eligible Ticket Purchasers may purchase Raffle tickets online at www.montezumaGOP.com/dream-home-raffle. At the time of online purchase, Eligible Ticket Purchasers must provide their name, email, address, phone number, credit card number, credit card security code, expiration date, and other information as MCRCC may require. There is an $8.00 credit card processing fee per ticket purchased via credit card which will be charged at the time of raffle purchase. You will receive a receipt via email with your ticket number, which will match an actual paper ticket number that will be put into the raffle drawing. You will not be mailed any ticket stub, as your emailed receipt will have all the information on it you will need. 

 

An email receipt will be sent immediately upon completion of the online sale. An official ticket number will be sent within 24 hours of purchase. If they do not receive any contact within 24 hours, Please contact Susan Lisak at (970)426-9902 or montezumaGOP@gmail.com

 

In Person:

Eligible Ticket Purchasers may also purchase tickets in person with any member of the Central Committee. Contact information is found at www.montezumaGOP.com or email montezumaGOP@gmail.com to connect to your nearest ticket seller. 

 

By Mail:

You can download a form you can fill out and mail by going to www.montezumaGOP.com/dream-home-raffle. Or just mail us your name, mailing address and phone number along with a check or money order made out to: Montezuma County Republicans, PO Box 1013, Cortez CO  81321. Please note on the check that payment is for the Dream Home Raffle. Please include an email address to receive an electronic confirmation of your ticket number, otherwise we will mail your ticket number to the address on file once your payment has cleared. 

 

Not Accepted:

No tickets may be held or set aside by voice, email or voice mail. Payment must be presented in order to receive a Raffle ticket. 

 

Other Info:

All entries must include payment by cash, check, money order, or credit card ($8 fee for credit card sales). Only one method of payment and only one mailing address are permitted. Only one name can be listed per ticket.

 

Tickets will be distributed and ticket numbers will be assigned in the order that payment is received. All payments will be deposited upon receipt. MCRCC reserves the right to reject any entry form that it deems defective, illegible, ineligible, or submitted without “good funds.”

 

In accordance with Applicable Law, MCRCC will not mail Raffle tickets to Ticket Holders. MCRCC will email a digital receipt for all online Ticket Purchases, and to other Ticket Purchasers upon request. Hard copies of official tickets will be available upon request or if purchasing your ticket directly from any member of the Republican Central Committee. To win a prize, Ticket Holders do not need to possess a hard copy of a Raffle ticket or a receipt in order to win and do not need to be present at the drawing. See “Rules Applicable to all Ticket buyers and the Prizewinner” for information on how to claim your prize if you are the winning ticket holder.

 

Cancellation Clause

The Raffle will only proceed with awarding the Grand Prize to a Ticket Holder once 1400 tickets have been sold. If 1400 have not been sold by the closing date of 12:00 PM on December 30, 2019, then the raffle will be cancelled and refunds given. 

 

If the Raffle gets cancelled, then we will refund monies within 2 weeks of the cancellation date in the following manner:

 

Cancellation and Refunding Online Ticket sales: credit cards will be refunded everything except the $8 credit card processing fee per ticket. The refund will be issued to the credit card account number that the original payment came from. An email advising that the Raffle has been cancelled and a refund given will be sent to each Ticket Purchaser. After notification, allow 7-10 days for refunds to show on the account.

 

Cancellation and Refunding of In-Person or mailed-in Ticket sales: Checks will be given as a refund to anyone who purchased their Raffle Ticket via cash, check, or money order. If a refund check is handed out in person, then the receiver will need to sign off showing that refund check has been received. We will attempt to contact everyone locally to hand refund checks off in person, but if unsuccessful after 2 weeks, we will mail any remaining checks to the address listed on the raffle ticket, unless an alternate is provided. Refund checks will be made out to the name that was on the check that the Ticket Purchaser originally submitted as payment. In the case of a ticket that was purchased by cash or money order, the refund check will be made out to the name on the Raffle ticket. Credit cards will be refunded everything except the $8 credit card processing fee per ticket. The credit card refund will be issued to the credit card account number that the original payment came from.

 

Other Refunds

All Raffle ticket sales are final. MCRCC will make no refunds except under the following circumstances: MCRCC will return any payment that MCRCC receives after (a) it has sold 2000 tickets or (b) after the Final Ticket Purchase Deadline. No other refunds are available except at the discretion of MCRCC. MCRCC assumes no responsibility for lost, late, misdirected, or non-delivered mail, or any other failure to receive orders prior to the drawing deadlines.

 

Odds of Winning

The odds of winning will depend on the number of tickets sold. If MCRCC sells all 2000 tickets, the odds of winning the Grand Prize are 1 in 2000. The chance of winning the Grand Prize will vary based upon the number of tickets sold, and if MCRCC sells less than 2000 tickets, the chance of winning the Grand Prize will increase.

 

Net Raffle Proceeds

As used herein, the term “Net Raffle Proceeds” means (a) the gross proceeds received by MCRCC received from the sale of tickets in the Raffle less (b) payment of all other prizes (whether or not claimed or awarded in the Raffle) and all Raffle-related expenses as determined by MCRCC. The determination by MCRCC will be binding in all events other than a manifest error made by MCRCC in the computation of the revenues and expenses of the Raffle.

 

MCRCC will use the net proceeds to: 1. Educate potential voters on Republican principles 2. Educate students at all grade levels on the political process 3. Provide for scholarship(s) to, but not limited to, Girls or Boys State, Internships to Washington DC, etc. for people of all ages.

 

Drawing Procedures

For all drawings, MCRCC will draw at random and determine winning tickets under the supervision of MCRCC’s certified games manager(s). Drawings will be open to the public, but winners need not be present to win.

 

At the discretion of MCRCC and subject to approval of the Colorado Secretary of State, MCRCC may extend or modify ticket purchase deadlines and drawing dates, times, and locations. The Grand Prize Winner will be posted on www.montezumaGOP.com. The MCRCC Certified Games Manager is the final authority in the event of any disputes regarding any of the drawings.

 

Grand Prize Drawing: At the Grand Prize Drawing, all eligible tickets will be placed into the Raffle bin and mixed thoroughly. At 12:00 PM on December 31, 2019, the certified games manager or assigned individual will pull one ticket out as the Grand Prize Winner. The drawing event will then conclude with the drawing of the Grand Prize.

 

At the discretion of MCRCC and subject to approval of the Colorado Secretary of State, MCRCC may extend or modify ticket purchase deadlines (the Final Ticket Purchase Deadline) and drawing dates, times, and locations. Any changes to the drawings will be posted on the Raffle website www.montezumaGOP.com/dream-home-raffle and purchasers will be notified. Raffle winner(s) will be posted on the Raffle website. The MCRCC Certified Games Manager(s) is the final authority in the event of any disputes regarding any of the drawings.

 

Rules Applicable to All Ticket Buyers and the Prizewinner

MCRCC will make reasonable efforts to contact the Grand Prizewinner using information provided on the winning entry form, either via phone or email. If a prizewinner does not contact MCRCC within 30 business days after the first initial contact notifying the Prizewinner of their winnings, then MCRCC shall give notice to such Prizewinner by U.S. Postal Service certified mail, return receipt requested, at the address set forth in the information provided by the Eligible Ticket Purchaser. This notice shall state (a) the prize won, (b) a telephone number of a contact person at MCRCC, (c) the time and location where the prize can be claimed, and (d) that if the prize has not been claimed within 30 days of the date the notification is given, that MCRCC may, at its option, retain the prize.


 

MCRCC will not award the Grand Prize if the Prizewinner (a) was ineligible to purchase a ticket or otherwise enter the Raffle, (b) provided materially false or misleading information to MCRCC in connection with the purchase of a raffle ticket, or (c) if participating in this Raffle or receiving a prize is prohibited with respect to such person pursuant to these Rules or Applicable Law. No other Raffle ticket will be drawn in the case of an ineligible Prize Winner, and MCRCC will retain the prize. A Ticket Holder cannot assign or transfer his/her interest in a Raffle ticket or a prize won by a winning Raffle ticket.

 

To Claim Your Prize: As a condition to being eligible to receive the Grand Prize, the Prizewinner must sign and deliver to MCRCC: (a) a sworn affidavit of eligibility under these Rules and Applicable Law and satisfactory proof that he/she is the person named on the winning entry; (b) a correct taxpayer identification number (e.g., social security number, individual taxpayer identification number, or employer identification number), (c) satisfactory proof that the purchaser of the ticket was an Eligible Ticket Purchaser at the time the ticket was purchased; (d) a publicity release, and (e) such other matters as MCRCC may reasonably request, such as proof of identification and proof of address to determine authenticity of individual claiming a prize. If the holder of the winning ticket does not provide a correct taxpayer identification number or otherwise comply with Applicable Law or these Rules, then MCRCC may, at its option, disallow the award of the Grand Prize to such Ticket Holder and retain the prize.

 

The winner of the Dream Home Raffle authorizes MCRCC to withhold all required amounts and report the award of Raffle prizes in accordance with Applicable Law. The Grand Prize Winner will be responsible for any income taxes due and any other withholdings due when taking ownership of the Grand Prize. The home and lot will be free of any liens at the time the deed is transferred. Any future HOA fees, property taxes, or any other taxes or fees will be the responsibility of the Prizewinner.

 

Each Ticket Holder agrees their name, likeness, voice and city of residence may be recorded by audio, video, or digital means and may be used in any print, audio or visual media without notice or compensation for any purpose including this or any other MCRCC Raffle or promotional materials.

 

Each Ticket Holder and each ticket buyer (a) agrees the MCRCC voting members and the current Home Owner are not responsible for any injuries, losses, or damages of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless MCRCC voting members, the current Home Owner, agents, advertising agency, contractors, insurers, attorneys, accountants, and affiliated entities from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of any prize, or that person’s failure to comply with Applicable Law; and (c) represents and warrants to MCRCC that they have read and understand these Rules and agree to be bound by these Rules and MCRCC’s decisions, which are final.

 

If there is a dispute of any kind regarding the award of a prize or the conduct of the Raffle, MCRCC and all persons purchasing or holding a ticket agree to arbitrate such dispute. The Colorado Secretary of State is the regulatory authority with jurisdiction over charitable gaming. If and to the extent the Secretary of State expressly deems a specific dispute between the MCRCC and person purchasing or holding a ticket outside of the Secretary’s authority, the MCRCC and the ticket holder agree to arbitration. If arbitration is regarding the winning prize, while such arbitration is pending, MCRCC, in its sole and absolute discretion, may deposit the prize with the then Clerk, or acting Clerk, of the District Court of Montezuma County, State of Colorado, interplead the parties hereto, and upon so depositing such prize and filing its complaint in interpleader it shall be relieved of all liability under the terms hereof as to the property so deposited. By the purchase of a ticket, all persons purchasing or holding a ticket (a) do submit themselves to the jurisdiction of said court and appoint the then Clerk, or acting Clerk, of said court as their Agent for the service of all process in connection with such proceedings and consent to the arbitration of disputes between them.

 

If the Grand Prizewinner timely provides the Evidence of Withholding Compliance, then MCRCC and the Grand Prizewinner will execute an agreement (the “Residence Conveyance Agreement”) that will, among other things, contain (i) a covenant that MCRCC will convey the Grand Prize to the Grand Prize Winner at a closing date (the “Residence Closing”), (ii) a covenant that the Grand Prizewinner will comply with the Withholding Requirements by paying to the appropriate government agencies all amounts necessary to satisfy the Withholding Requirements at the Closing, and (iii) other covenants customarily contained in agreements utilized by the Home Owner for the sale of residences similar to the Home.

 

The Grand Prizewinner acknowledges that MCRCC makes no representations or warranties, express or implied, regarding (a) the fair market value of the residence or (b) any aspect of the construction, physical condition, or suitability for the Grand Prize Winner’s intended uses or purposes, zoning, value, or otherwise relating to the Home.

 

Registration with the State Of Colorado and Applicable Law

This Raffle is being conducted pursuant to Bingo-Raffles License #2019-14298 issued to Montezuma County Republican Central Committee, by the Colorado Secretary of State’s Office, and is being conducted in accordance with the applicable provisions of the Colorado Constitution (Section 2 of Article XVIII), Colorado’s Bingo and Raffles Law (Colorado Revised Statutes, Title 12, Article 9, Sections 101 to 301), and Colorado’s Rules Covering and Regulating Bingo/Raffles (8 CCR 1505-2).

 

The Raffle is subject to these Rules, the laws of the State of Colorado, and Applicable Law. If there is a conflict between these Rules and the laws of the State of Colorado, the laws of the State of Colorado shall govern. MCRCC reserves the right to modify the Rules and/or impose additional conditions, procedures, and requirements as may be necessary or required for the Raffle and the award of prizes hereunder to comply with the laws of the State of Colorado and Applicable Law. This Raffle is void where prohibited by law.
